Chief Commissioner Approval

What is it?

A Chief Commissioner Approval authorises an individual or organisation to engage in activities otherwise prohibited by the Act. This may include:

  • the manufacture, sale or purchase of prohibited weapons and body armour
  • the display or advertisement for sale of prohibited weapons and body armour
  • the possession, use, carriage or transportation of prohibited weapons and body armour

How do I get it?

Approval is subject to certain general conditions and may be subject to other additional conditions or limitations that the Chief Commissioner deems appropriate. The Chief Commissioner also cannot extend approval to certain individuals or categories of people.

Where do I find the form?

Application forms can be obtained online or in person from the Licensing & Regulation Division.

Note there are two application forms - one for individuals and one for body corporates (including trading purposes).

What information will I need to supply?

For an individual application for a Chief Commissioner's Approval, an applicant will need to supply:

  • contact details
  • their Victorian Drivers Licence Number
  • proof of identification where the application does not hold a current Victorian Firearms Licence or Private Security Licence. Applicants will need to provide certified copies of one Primary identification document (ie. a current passport) and one or more Secondary identification documents (ie. Medicare care) equal to or more than 100 points
  • identification reference from an acceptable referee
  • a certified copy of any change of name document (change of name certificate; full birth certificate that includes the schedule of any name changes; or marriage certificate)
  • history of offences committed by the applicant where the applicant has a history. This includes both Australian and international offences and any pending charges the applicant faces
  • history of any previous applications to the Chief Commissioner concerning prohibited weapons and body armour, irrespective of whether an application was granted, rejected or revoked
  • a medical report from a doctor who has treated the applicant or is familiar with the condition the applicant has experienced and which the applicant acknowledges may preclude their obtaining approval
  • declaration that the applicant can satisfy storage requirements
  • their reasons for applying for Approval, including documentation proving the applicant's need for a Prohibited Weapon, and
  • Written consent of a parent or guardian if the applicant is under 18 years of age.

For a body corporate application for a Chief Commissioner Approval, an applicant will need to supply:

  • business details (ie. ABN, ACN)
  • contact details
  • details of any Nominated or Responsible persons who will be accountable for the storage and day to day management of all items under this licence
  • a Victorian Drivers Licence Number for all Nominated or Responsible persons
  • Proof of identification for all Nominated or Responsible persons where these persons do not hold a current Victorian Firearms Licence or Private Security Licence. Applicants will need to provide certified copies of one Primary identification document (ie. a current passport) and one or more Secondary identification documents (ie. Medicare care) equal to or more than 100 points
  • a certified copy of any change of name document for all Nominated or Responsible persons (change of name certificate; full birth certificate that includes the schedule of any name changes; or marriage certificate).
  • history of offences committed by all Nominated or Responsible persons where the Nominated to Responsible persons have a history. This includes Australian and international offences as well as any pending charges the applicant faces.
  • history of any previous applications to the Chief Commissioner by all Nominated or Responsible persons concerning prohibited weapons, including Approvals that were granted, rejected or revoked.
  • medical report from a doctor who has treated all Nominated or Responsible persons or is familiar with any conditions all Nominated or Responsible persons have experienced and which a Nominated or Responsible person acknowledges may preclude them from obtaining approval.
  • declaration that the applicant can satisfy storage requirements, and
  • reasons for applying for approval, including documentation proving the applicant's need for involvement with a prohibited weapon or body armour.

Fees

Successful applications attract prescribed fees. A money order or personal cheque made out to the Licensing Services Division must accompany all applications in the first instance. Where an application is rejected, this will be returned to the applicant.
