The Assistant Commissioner, North West Metro Region, acting as a delegate of the Chief Commissioner of Police, under section 10D(1) of the Control of Weapons Act 1990, declares a designated area at the Melbourne Convention and Exhibition Centre and South Wharf.
The designated area is bounded by all public places within the area bounded by (including the streets, roads, intersections and footpaths defining the boundary) the intersection of King Street and Flinders Street, west to the intersection of Flinders Street and Montague Street, south to the intersection of Montague Street and Normanby Road, east to the intersection of Normanby Road and King Street and north to the intersection of King Street and Flinders Street.
This includes public places within the Melbourne Convention and Exhibition Centre.
This declaration will operate during:
- 11 September 2024, 7am-6pm
- 11 September 2024, 7pm-9.30pm
- 12 September 2024, 7am-6pm
- 12 September 2024, 6.30pm-10pm
- 13 September 2024, 9am–5pm
During these times, members of the police force are authorised to exercise the following powers:
- In a public place in the designated area, without warrant, stop and search for weapons:
- any person
- anything in the possession or control of the person
- any vehicle with a person in or on the vehicle
- anything in or on such vehicle.
- Detain a person or vehicle for so long as is reasonably necessary to conduct a search.
- Seize and detain any item the member reasonably suspects is a weapon.
- Request a person who is the subject of a full search to disclose his or her identity.
- Direct a person to leave the designated area if the police officer reasonably believes the person is wearing a face covering primarily to:
- conceal their identity
- protect them from the effects of a crowd control substance, and the person refuses to remove the face covering when requested to do so.
- Direct the person to leave the designated area if the police officer reasonably believes the person intends to engage in conduct that would constitute an affray (section 195H Crimes Act 1958) or violent disorder (section 195I Crimes Act 1958).
